1. Applicability of Conditions of Application

1.1 Application to participate in D&F Academy gGmbH (“D&F Academy”) projects shall be governed by the present Conditions of Application. These Conditions shall apply to the exclusion of all other conditions. By placing your application, you acknowledge that you have read, understood and accepted, without reserve, the present Conditions of Application.

1.2 By using this Website, you also accept and agree to be bound by our Terms of Use and Confidentiality Policy. The D&F Academy invites you to read them carefully before using this Website.

1.3 The D&F Academy reserves the right, at any time, to modify the present Conditions of Application by posting a new dated version on this Website. By placing your application after the D&F Academy has posted a new version of its Conditions of Application, you agree to be bound by that updated version.  

2. Registration

2.1 When you register on this Website, you must ensure that the mandatory application information you provide is correct and complete.

2.2 Please inform the D&F Academy about changes of address or other modifications by updating your personal details on this Website without delay.  

3. Password

3.1 When registering to this Website, you will be asked to create a password. You must keep this password strictly confidential and not disclose it or share it with anyone.

3.2 You are fully responsible for the use of your password and any orders placed under it, even without your knowledge.

3.3 If you know or suspect that someone else knows or has used your password, you should notify the D&F Academy immediately.

4. Application

4.1 By registering to this Website you apply to participate to a specifically selected project as described on this Website.

4.2 Children under the age of 18 can not apply for a project.

4.3 Applying for a project does not create any contractual relationship between the D&F Academy and the applicant and does not grant any right to participate to any project of the D&F Academy.

4.4 Application will be processed within three weeks after the deadline for applying and applicant retained for the project will receive a written confirmation from the D&F Academy.

4.5 The written confirmation of the D&F Academy does not create any contractual relationship between the D&F Academy and the applicant. Contractual relationship between the D&F Academy and the applicant is conditioned upon a written agreement. No contractual relationship between the retained applicant and the D&F Academy will be in force before a written agreement is in place.

4.6 The D&F Academy does not guarantee that a project for which an application has been submitted or even retained will effectively take place and will be undertaken. After application results, the project may be dropped for any reason the D&F Academy has no obligation to disclose. The D&F Academy will inform the applicant as soon as possible if a project is dropped or delayed. In such a case all documents and data received from the applicant will be returned to the applicant or deleted if the applicant does not instruct the D&F Academy otherwise.

4.7 The D&F Academy shall not be held liable in case the project is dropped after the application deadline and the applicant has been retained. Applicants retained by the D&F Academy have no right against the D&F Academy.

4.8 Application results are secret and applicants have no right to obtain or contest these results.

4.9 Applicants have no right of recourse against the application results.  

5. Applicable Law and Forum

5.1 These Conditions of Application and applications shall be governed by the laws of the Federal Republic of Germany

5.2 The place of performance is Hamburg, Germany. The applicant accepts the exclusive jurisdiction of the Courts of Hamburg, Germany.
